    The owner of this Site (Eloise Gagnon) and its directors, agents, and employees assume no responsibility or liability for any consequences resulting directly or indirectly from any action or inaction you take based on the information found on or material linked to on this Site.

    Any information provided by or on this Site is for promotional or informational purposes only and is not to be relied upon as a professional opinion. By using this Site, you accept and agree that following any information or recommendations provided therein is at your own risk.

    The following terms and conditions form a binding agreement (“Agreement”) between you and EAC Leadership House Inc., a company incorporated in Quebec, Canada, and solely owned and operated by Eloise Gagnon. EAC Leadership House Inc. may modify, amend, supplement, and replace these terms and conditions at any time without advance notice.

    Your continued use of this Site after any changes signifies your acceptance of the modified terms and conditions.

    Canadian copyright laws protect all materials created by EAC Leadership House Inc. on this Site as original works. All materials belong to EAC Leadership House Inc., including those without a registered copyright symbol.

These links are provided to enhance your use of the Site, enable you to connect with Eloise Gagnon on various platforms, and help Eloise Gagnon offer the most accessible services for you and conduct transactions.

    Intellectual Property Ownership

    If we provide materials on this Site that you can download, a revocable, non-exclusive license is granted for you to download copies of the materials for personal, non-commercial transitory viewing only.

    This is a grant of a license, not a transfer of title, and under this license, you may not:

    • Modify or copy the materials;
    • Use the materials for any commercial purpose or public display (commercial or non-commercial);
    • Share or transfer the materials to another person or “mirror” the materials on any other server.

    This license shall automatically terminate if you violate any of these restrictions and may be terminated by Eloise Gagnon at any time. Upon termination of this license, you must destroy any downloaded materials in your possession, whether in electronic or printed format.

    If Eloise Gagnon discovers that you have illegally misappropriated or used any of the intellectual property you were granted access to, you will be blocked from any future programs, and we will pursue any and all legal remedies. You will also be required to cover all legal fees necessary to enforce these rights.

    Confidentiality

    By participating in our group coaching program, you agree to maintain the confidentiality of all information shared within the sessions. This includes but is not limited to personal stories, experiences, opinions, and any other information disclosed by fellow participants or the coach.

    You agree not to disclose, share, or distribute any information shared within the sessions to any third party without explicit consent from the individual(s) involved.

    By participating in our group coaching program, you acknowledge and agree that live sessions are recorded and may be shared with current and future participants of the program to maximize learning opportunities. Recordings are securely stored and made available only to active, enrolled members of the program.

    You agree not to reproduce, share, or distribute these recordings outside the program community. Failure to adhere to this agreement may result in immediate expulsion from the program, without refund.

    Failure to adhere to this confidentiality agreement may result in immediate expulsion from the program, without refund, at the discretion of the coach or program administrator.

    Your commitment to confidentiality is vital in creating a safe and supportive environment for all participants. Thank you for respecting the privacy and trust of your fellow members.

    Testimonials

    We love to share our students’ wins and successes from inside our programs. By signing up for any Program, you grant Eloise Gagnon and EAC Leadership House Inc. permission to use any testimonials in our marketing materials and/or any promotional efforts. This includes but is not limited to unofficial testimonials, words of praise via Instagram stories, public posts, or posts inside our Facebook group, and direct messages with Eloise Gagnon.

    We will blur full names on screenshots used, and you understand that all confidentiality provisions apply and that testimonials are the only exception to our confidentiality obligations.

    Refund Policy

    All sales are final for digital products and instant-access programs. This includes, but is not limited to:

    • 5-Day Mindset Reset

    • Power & Presence Bundle

    • Communication Mastery Vault

    • Expert to Leader Challenge

    • Emotional Mastery Vault

    • All pre-recorded workshops, masterclasses, guides, and templates

    Due to the nature of digital content delivery, refunds will not be issued under any circumstances. By purchasing, you acknowledge and agree that you are receiving full, irrevocable access to intellectual property and waive you right to request a refund.

    Cancellation Policy

    To be eligible for a cancellation and refund request for Power Player Academy, participants must complete Phase 1 of the program, which includes the following requirements:

    1. Watch All Phase 1 Videos: Participants must view all training videos included in Phase 1 in their entirety. Completion of video content will be verified through system tracking.

    2. Complete the Phase 1 Workbooks: Participants must submit completed workbooks for all sections of Phase 1. Submissions should demonstrate meaningful effort and application of the program content.

    3. Attend at Least One Coaching Session: Participants are required to attend a minimum of one live coaching session during Phase 1. Attendance will be verified through session registration and participation logs.

    Requests for cancellations and refunds will only be considered if all three conditions above have been met within the specified timeline of two weeks from the date of enrolment. Failure to fulfill any of the above requirements will result in ineligibility for a refund.

    This policy ensures that participants fully engage with and apply the program content before making a decision to withdraw, as the program’s effectiveness relies on active participation and commitment.

    Blocklist + Disputed Payments

    Eloise Gagnon retains the right to ‘Blocklist’ you from accessing all materials, courses, or other products or services she offers in the event that you do not pay your outstanding balance, dispute your payments, or if you steal any of our intellectual property.

    A student will be removed from the blocklist at the discretion of Eloise Gagnon, under the conditions that: (1) the outstanding balance has been paid in full, and (2) the student is not eligible for a refund for the remainder of their course access.

    In the event that a student wants to regain access to our Program after disputing a payment, the student agrees to pay the Stripe or PayPal fee for each payment previously disputed.

    Payment Plans

    You will have two payment plan options with Eloise Gagnon.

    You can either pay up-front in full or pay in monthly installments. Please note that for monthly payments, Stripe or PayPal will automatically deduct the amount from the account information you provide to Stripe or PayPal.

    In the event a payment fails, you will not be able to access any of the information or content sold through our Site. In the event of three failed payments, you understand that Eloise Gagnon may contract a collection agency to collect the money from you. If you wish to pay off your remaining account balance in full, you can do so at any time.

    Please note that a payment plan is not a membership and cannot be canceled at any time. By signing up for our payment plan, you agree to pay the full balance owing on your payment plan.

    Breaking Payment Plans + Discontinued Payments

    In the event that your agreed-upon payment plan is broken, our team will permit a three-month grace period and will actively work with you to get payments back on track.

    However, after three months of delinquent payments, you will be charged a 10% fee of the monthly payment due for every month of missed payments after that, for up to one year. The 10% late fee will only commence after your initial three-month grace period.

    To get back on track with our program after 3+ months of delinquent payments, you must make up for ALL past-due payments and late fees. Your access will be re-granted once your entire account is paid off.

    Expiration of Coaching and Mentoring Sessions

    To ensure consistency and progress in your coaching journey, all included sessions must be utilized within the specified timeframes outlined below:

    • Single Coaching Session Packages: Must be scheduled and utilized within 3 months of purchase.
    • 3-Month Mentoring Programs: All sessions must be scheduled and completed within 6 months of the program start date.
    • 6-Month Mentoring Programs: All sessions must be scheduled and completed within 9 months of the program start date.

    Failure to schedule or utilize sessions within these timeframes will result in forfeiture of the unused sessions, with no refunds provided.

     

    Office Hours and Support Availability

    We are committed to providing excellent support to all program participants. To ensure clarity and efficiency, we are available to assist during the following office hours:

    • Monday to Friday: 8:00 AM – 5:00 PM EST
    • Weekends and Public Holidays: Closed

    Inquiries or requests received outside these hours will be addressed on the next business day. While we aim to respond promptly, please allow up to 48 hours for a reply during peak periods.

    Thank you for understanding our need to maintain balanced schedules to better serve you.

    Rescheduling of Sessions – 1:1 Mentoring Program

    In the interest of maintaining the integrity of our coaching program and respecting the time commitments of both parties, it is hereby agreed that repeated rescheduling of sessions beyond the terms outlined herein shall be considered as completed sessions.

    For the 3-month mentoring program, a maximum of two rescheduled sessions is permissible for emergencies or unforeseen circumstances. For the 6-month mentoring program, a maximum of five rescheduled sessions is permissible for emergencies or unforeseen circumstances.

    While we understand that unforeseen circumstances may arise, necessitating the occasional rescheduling, any rescheduled session beyond the agreed-upon limit shall be deemed fulfilled, and no further rescheduling shall be permitted without mutual agreement.

    This limit is implemented to ensure the consistency and progress of the coaching process while respecting the time commitments of both parties.

    Early Termination Clause

    In the event that a client terminates their mentoring program before the official end date or before full payment, a penalty equivalent to 50% of the remaining amount owed will be applied.

    This penalty is intended to compensate for the time and resources allocated for the remaining sessions and to uphold the commitments made at the time of enrollment.

    The penalty will be deducted from any outstanding balance owed by the client upon termination of the program.

    This clause is enforceable regardless of the reason for early termination and serves to ensure fairness and accountability in the mentoring relationship.

    In the event that the client fails to adhere to the terms and conditions outlined in this agreement, Eloise Gagnon reserves the right to terminate the contract with immediate effect. Such termination shall be at the discretion of Eloise Gagnon and may occur without prior notice. The client shall be notified of the termination in writing, and any outstanding obligations or payments owed to Eloise Gagnon shall remain due and payable by the client.

    No Guarantees

    We make NO GUARANTEES about any success that you’ll get from our Site or our Programs.

    We will do everything to support your success, but we make no guarantees since we can only control so much about your results.

    You understand that Eloise Gagnon makes no guarantees whatsoever regarding any results based on any action or inaction relating to your life, professional development, social media accounts, career, or businesses based on the information we share or services we sell or share for free through the Site.

    Ultimately, we will not be responsible or make any promises for what will happen in your life, career and business. Even if you’ve worked with us as a client before and had certain results, we make no guarantee that they will happen again. We cannot be any clearer about this: We are here for you and want you to succeed, but we make no promises regarding results and make no guarantees whatsoever.

    Zero Bullying and Respect Policy

    We are committed to fostering a positive, respectful, and inclusive environment for all participants, team members, and coaches. By participating in our programs or engaging with our team, you agree to uphold this standard.

    The following behaviours are strictly prohibited:

    • Bullying, harassment, or any form of intimidation towards other participants, team members, or coaches.
    • Disrespectful language, including verbal abuse, derogatory remarks, or inappropriate comments.
    • Disruption of sessions or activities that hinders the learning experience for others.

    Violation of this policy may result in:

    1. A written warning regarding the unacceptable behavior.
    2. Immediate revocation of program access, with no refund or compensation for unused sessions or materials.

    We reserve the right to determine, at our sole discretion, what constitutes bullying, harassment, or disrespectful behaviour. Protecting the safety and well-being of all participants and team members is our top priority.

    Thank you for contributing to a positive and professional environment.

    Entire Agreement

    These terms and conditions, along with any other legal notices, policies, and guidelines of Eloise Gagnon linked to these terms and conditions or contained on this Site, constitute the entire Agreement between you and Eloise Gagnon relating to your use of this Site and supersede any prior understandings or agreements (whether oral or written), claims, representations, and understandings of the parties regarding such subject matter.

    This Agreement may not be amended or modified except by Eloise Gagnon.

    Site Terms of Use Modifications

    Eloise Gagnon may revise these terms of use for this website at any time without notice. By using the Site, you are agreeing to be bound by these Terms and Conditions of Use.

    Limitation of Liability

    In no event shall Eloise Gagnon be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to view or use the materials or content on the Site, even if Eloise Gagnon has been notified orally or in writing of the possibility of such damage.

    Governing Law

    Any claim relating to Eloise Gagnon’s website shall be governed by the laws of the Province of Quebec without regard to its conflict of law provisions.

    Indemnity

    As a condition of your use of the Site, you hereby indemnify Eloise Gagnon and its directors, agents, and employees from and against any and all liabilities, expenses (including legal fees), and damages arising out of claims resulting from or arising from your use of this Site.
